TOWN OF LAMARTINE
Board of Appeals
Variance Hearing
Petitioner: Rich and Sandy Ryan
May 25, 2005
6:30 PM
Lamartine Municipal Building Meeting Room
The Clerk made introductions.
The following members on the Town of Lamartine Board of Appeals were present at this meetingChairman Greg Michels, John Potratz, Roger Searl, Mike Pittler and Harold (Bud) Guenther.
Also present at this meeting were petitioner Sandy Ryan and her contractor Randy Comeaux.
With notices having been properly posted and published Chairman Greg Michels called the meeting to order.
The Clerk read the letter of intent. The letter stated that owners Mr. and Mrs. Ryan at W9033 Johnson Road in the Township of Lamartine were requesting a variance in the minimum setback of one hundred (100) feet to Seventy-one (71) feet to build an additional 3-car garage. The letter further stated that the garage must be positioned this close to the road due to the pump chamber, septic tanks and mound system. The Ryans felt that building the garage at this location on their property was the only option.
Greg Michels asked the petitioner if there were any additional comments to add to their letter of intent. Mrs. Ryan stated that she had none.
There were no opinions offered from Fond du Lac County Planner Sam Tobias or the Town Building Permit Issuer Pete Michels.
Randy Comeaux showed the Board the site layout and why the proposed garage addition had to be built at this location at a seventy-one (71) foot road setback.
Discussion took place regarding this variance request.
John Potratz made a motion to vote on the variance request to allow a 71-foot road setback. Mike Pittler seconded this motion. Chairman Michels explained that a YES vote would mean the variance is granted and a NO vote would mean the variance would not be granted.
Let the record show that 5 paper ballots were cast with the following results: YES4 votes and NO1 vote.
Greg MichelsYES, Mike PittlerYES, Harold GuentherYES
Roger SearlYES and John PotratzNO.
The Board of Appeals voted 4 to 1 to grant this variance request to allow Rich and Sandy Ryan to build a garage addition at a minimum setback of seventy-one (71) feet.
Bud Guenther made a motion seconded by John Potratz to destroy the ballots. Motion carried.
With no further business to discuss, Roger Searl made a motion to adjourn the meeting. John Potratz seconded the motion. Motion carried.
Respectfully Submitted,
Jill Randall, Municipal Clerk
